Welcome to Tocoop. These General Terms and Conditions apply to all Tocoop Customers and playing on all our platforms which include the website and the mobile platform.
By using and/or visiting any section (including sub-domains) of the Tocoop website or any other applications (like the mobile applications) that we own and/or registering on the website, you agree to be bound by:
I- These Terms and Conditions;
III- The Rules applicable to our gaming products are deemed to have been accepted and understood with all Terms.
Please read the Terms carefully and if you do not accept the Terms, do not use the Website or mobile platform.
3- All applicants must be over 18 years of age to register with Tocoop and we reserve the right to ask for proof of age from any customer and suspend their account until satisfactory documentation is provided.
4- You agree to provide all required information on registration. This information must be accurate and we must be informed of any change in details. You may be asked to provide personal information.
5- It is illegal to use and/or abuse an error or an instance of incompleteness on the Client application, and/or in any of the Software and/or Services provided by Tocoop. Should the customer detect or become aware of such an error or incompleteness, they shall:
a. Refrain from taking any advantage whatsoever thereof;
b. Keep strictly confidential such error or incompleteness;
c. Upon detection or becoming aware of such error or incompleteness notify Tocoop immediately.
6- You authorize us to use any means necessary at any time to verify your identity and any information that you have provided us about yourself.
7- You agree to inform us of any errors that might have occurred on computations or system malfunction regarding games that you have plyed on your account. We reserve the right to declare null and void any games that might have been played after such errors.
8- You agree to keep your username, password and security details strictly confidential. You should change your passwords on a regular basis, and never disclose to any third party. We will assume that any transaction carried out on your account is by you and notifications will be sent to electronic mails that you have provided. You should protect your usernames and passwords as cash in your pocket, failure to do so is at your risk and expense.
9- Online users must promptly inform us if their account is being used by a third party or its security has been compromised in any way. Such account will be subsequently suspended.
10- Online customer must never use Tocoop account for trading on behalf of third parties. Contravention will attract closure of such account. We will not be liable to any third party, where such abuse has occurred.
11- Where you play any game using the Website or app, you accept and agree to be bound by, the Rules which apply to the applicable products available on the website from time to time.
12- We may need to change the Terms from time to time for a number of reasons (including complying with applicable laws and regulations, and regulatory requirements). Any minor or insubstantial changes may be made at any time and you are advised to review the Terms on a regular basis. If any change is unacceptable to you, you should cease using the website and/or close your account or stop using our app. If, however, you continue to use the Website and continue to visit our app after the date on which the changes to the Terms come into effect, you will be deemed to have accepted those changes.
13- All information supplied when registering with the site MUST be accurate and complete in all respects. In particular, if using a credit or debit card, the cardholder's name MUST be the same as the name used when registering with the website Where this is not the case, the relevant account will be suspended. Where an account is suspended, the relevant customer should Contact Us. All games that are played prior to an account being suspended will stand win or lose.
14- By accepting the Terms and/or registering to use the website you hereby agree that we shall be entitled to conduct any and all such identification, credit and other verification checks from time to time that we may require and/or are required by applicable laws and regulations and/or by the relevant regulatory authorities for use of the website and our products generally. You agree to provide all such information as we require in connection with such verification checks. We shall be entitled to suspend or restrict your account in any manner that we may deem in our absolute discretion to be appropriate, until such time as the relevant checks are completed to our satisfaction.
15- Customers may open only one account. Should we identify any customer with more than one account we reserve the right to treat any such accounts as one joint account or close the account permanently.
16- Tocoop allows all its customers to choose their own username and password combination. Customers must keep this information secret and confidential as you are responsible for all game played on your account and any other activities taking place on your account.
17- Games will only stand if the username and password provided by the customer is entered correctly (whether or not authorized by you), subject to there being sufficient funds in the account.
18- If, at any time, a customer feels a third party is aware of his user name and/or password, such should be change immediately.
19- Tocoop reserves the right to close or suspend your account at any time and for any reason. Without limiting the preceding sentence, the company shall be entitled to close or suspend your account if:
If it is discovered that you have used the website or app in a fraudulent manner or for illegal and/or unlawful or improper purposes;
The company considers that you have used the website or app in an unfair manner or have deliberately cheated or taken unfair advantage of the company or any of its customers;
20- If your account is deemed to be dormant and its balance is, or reaches zero.
21- If your account remains "inactive" for a continuous period of 365 days then your account shall be deemed to be "dormant" and, if the balance on your account is zero, your account will be closed and no fee shall apply.
22- Tocoop actively monitors traffic to and from the website and app. The company reserves the right in its sole discretion to block access where evidence indicative of automated or robotic activity is found.
23- From time to time, all or part of the Website/app may be unavailable for use by you because of our maintenance of the Website/app and/or alteration or amendment of any of the products.
24- The company does not accept any liability for any damages, liabilities or losses which are deemed or alleged to have arisen out of or in connection with the website/app or its content including delays or interruptions in operation or transmission, loss or corruption of data, communication or lines failure, any person's misuse of the website/app or its content or any errors or omissions in content.
26- Nothing in these Terms and Conditions shall create or be deemed to create a partnership, joint venture or principal-agent relationship between the parties and no party shall have authority to bind any other in any way unless expressly provided otherwise in these Terms and Conditions.
27- Tocoop shall not be in breach of these Terms and Conditions nor liable for delay in performing, or failure to perform, any of its obligations if such delay or failure results from events, circumstances or causes beyond its reasonable control including(without limitation) any telecommunications network failures, power failures, failures in third party computer hardware or software, fire, lightning, explosion, flood, severe weather, industrial disputes or lock-outs, terrorist activity and acts of government or other competent authorities. In such circumstances the time for performance shall be extended by a period equivalent to the period during which performance of the obligation has been delayed or failed to be performed.
28- We issue refunds for digital products within 7 days of the original purchase of the product. We recommend contacting us for assistance if you experience any issues receiving or downloading our products.
29- To top-up your balance, you can directly buy the item (Coin / Gem /...) or you can buy item individually by clicking on [+] icon on top of your app.
This Coordination Agreement shall be governed by and construed in accordance with the laws of The Netherlands without regard to the principles of conflicts of laws thereof.
- In consideration of the rights granted to you to use the services, you represent, warrant, covenant and agree that:
- You are not under the age of 18 or any legal age required for gaming activities under the law or jurisdiction that applies to you;
- You are the rightful owner of the money in Your Account and all details provided by you to the Company either during the registration process or at any time thereafter, including as part of any payment deposit transaction, are true, current, correct and complete and match the name(s) on the credit/debit card(s) or other payment accounts to be used to deposit or receive funds in your account.
- You are fully aware that there is a risk of losing money and you are fully responsible for any such loss. You agree that your use of the services is at your sole option, discretion and risk. In relation to your losses you shall have no claims whatsoever against the Company.
- You fully understand the methods, rules and procedures of the services in general. You understand that it is your responsibility to ensure the details of games are correct. You will not commit any acts or display any conduct that damages the reputation of the Company.
- By agreeing to the Terms you authorize us to undertake any verification checks we may require or that may be required by the third parties (including, regulatory bodies) to confirm your identity and contact details (the "Checks").
- During these Checks we may restrict you from withdrawing funds from Your Account.
- If any of the information that you provide to us be untrue, inaccurate, misleading or otherwise incomplete, you will be in breach of contract and we reserve the right to terminate your account immediately and/or prevent you from using the services, in addition to any other action that we may choose to take.
- If we are unable to confirm that you are at the Legal Age then we may suspend Your Account. If a fact that you were under the Legal age at the time you made any gaming transactions, then:
your Account will be closed;
all transactions made during that time will become void, and all related funds deposited by you will be returned;
any stakes or games made during that time will be returned to you;
any winnings which you have accrued during that time will be forfeited from you and you will be required to return to us all funds that were withdrawn from Your Account.
